You represent and warrant that all the information you provide is correct, current, and complete, and that you have all rights necessary to provide it.

Your account is personal to you. You are solely responsible for maintaining the security of your account credentials and for all activity that happens under your profile. You may not transfer, sell, assign, or licence your account to any other person.

We have made every effort to provide an accurate representation of our products in our online store. However, please note that colours or product appearance may differ from how they appear on your screen due to the type of device you use to access the store, alongside your specific settings and configuration.

Our footwear and lifestyle gear are designed strictly for casual and everyday wear, engineered with exceptional craftsmanship and elemental power. They are not medical devices or high-performance athletic equipment. We do not warrant that the appearance or quality of any products you purchase will perfectly meet your expectations or be identical to digital renderings.

All product descriptions are subject to change at any time, without notice, at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products we offer to any person, geographic region, or jurisdiction on a case-by-case basis.

SECTION 3 - ORDERS & MARKETPLACES

When you place an order on our website, you are making an offer to purchase. ELMT reserves the right to accept or decline your order at its discretion for any reason. Your order is not accepted until ELMT confirms acceptance. We must receive and process your payment before your order is finalised. Please review your order carefully before submitting, as ELMT may be unable to accommodate cancellation requests after an order is accepted.

If we do not accept, change, or cancel an order, we will attempt to notify you via the email address, billing address, and/or phone number provided at the time the order was placed.

Marketplaces: Please note that when you purchase ELMT products through authorised third-party channels (such as our future Lazada storefront), that specific platform's rules, checkout terms, and independent operations will apply alongside these Terms.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs, or import charges.

Prices posted in our online store may differ from prices offered in online or physical spaces operated by third parties. We may, from time to time, offer promotions that affect pricing and are governed by terms separate from these Terms. If a conflict arises between promotional terms and these Terms, the promotional terms will govern.

You agree to provide current, complete, and accurate purchase, payment, and account information for all transactions. You agree to promptly update your account details, including your email address, credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the payment information you provide is true, correct, and complete, (ii) you are duly authorised to use such payment method for the purchase, (iii) charges incurred by you will be honoured by your card company or bank, and (iv) you will pay all charges incurred at the posted prices, including shipping and handling charges and all applicable taxes.

SECTION 5 - RETURNS & REFUND POLICY

Refunds: Monetary refunds are strictly reserved for products that arrive defective or faulty. If you receive a defective item, please notify us within 4 days of delivery with proof of the fault to qualify for a full refund. Approved refunds will be credited back to your original payment method. The customer bears all associated shipping costs.
Exchanges and Change of Mind: If you wish to return your items to change your size, or if you simply experience a change of mind, you may return the footwear within 14 days of delivery. The items must be entirely unworn, undamaged, and in their original packaging. For all size exchanges or change-of-mind returns, the customer bears all associated shipping costs.

SECTION 6 - SHIPPING AND DELIVERY

We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

SECTION 7 - PRIVACY & DATA USAGE

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the experience for you. Information you submit will be transmitted to and shared with Shopify, as well as with third parties that may be located in countries other than where you reside, in order to complete your services.

Intellectual Property & AI Protection: Everything on our website and official channels—including our text, footwear designs, code, graphics, photos, and branding—belongs exclusively to ELMT or our partners. You are strictly prohibited from copying or using our designs without express written permission. Furthermore, you may not use any content, images, data, or product details from our website to train, test, or validate machine learning models or artificial intelligence systems.
